MEMBERSHIP AGREEMENT / RELEASE OF LIABILITY

  1. Goal/Mission: Manuia Polynesian Revue - Rocklin ("Manuia") is dedicated to the performance of the music and dances of the Polynesian islands with respect to the tradition and culture of each island. Our repertoire includes music and dances from Tahiti, Samoa, Hawaii, New Zealand, and Tonga. Manuia is a professional, family-oriented performing and competitive dance company that promotes having fun and performing for the love of dance. Manuiais operated by its directors (“Directors”) currently composed of: Tommy Tualaulelei, Camille Tualaulelei, Kristen Tualaulelei-Cruz, and Alfredo Cruz.

  2. Conflict of Interest: Manuia considers it a conflict of interest for the Directors, instructors, students, guardians, musicians, drummers, and volunteers ("Members”) to belong to any other Polynesian dance group and considers it grounds for termination of membership from Manuia.

  3. Tuition Commitment: Non-refundable initial enrollment fee of and tuition commitment amount will be determined by the Directors and are due to Manuia from each student. Tuition is due on the 26th of every month for the upcoming month. See Addendum I below for “Tuition / Payment Fee Schedule”. No refunds will be given if you stop attending classes before the end of your billing commitment period. Required initial minimum tuition commitment period of 3 months. Students may pay the whole commitment amount at one time or have the option of paying monthly. Both options will be done via credit/debit card or auto-debit from Member's financial institution. For Members that choose to pay monthly, if you stop attending (due to illness or vacation) before the end of the commitment period, you will still be responsible for the full tuition of your commitment period. Tuition Commitment periods will automatically renew. If Members do not wish to renew, you are required to provide Manuia a written notice at least 30 days prior to the end of your commitment period.

  4. Holidays & Vacation: We will recognize and close the studio on the following holidays: New Year's Day, President's Day, Memorial Day, 4th of July, Labor Day, Thanksgiving, Day after Thanksgiving, Christmas week, and New Year's week. If a holiday falls on a weekend, we will inform you when the holiday will be observed for the studio closure. Ordinarily, holidays falling on a Saturday will be observed the preceding Friday; holidays falling on a Sunday will be observed the following Monday. If the class you attend falls on a holiday, you may request to participate in a make-up class, at the discretion and approval of the Directors. Regarding vacation, the Directors reserve the right to schedule and close the studio for vacation and time-off. During these periods, Members may request to participate in alternative classes appropriate for your age and skill level.

  5. Professionalism: To participate with Manuia, Members must exhibit high professional demeanor and/or attitude at classes, performances, activities, and rehearsals. No disrespect, gossip, obscene language, or inappropriate conversations are tolerated by either students or guardians. If Members lack professional demeanor during classes, performances, activities, and rehearsals, it may lead to termination of membership from Manuia.

  6. Performances: In order to perform with Manuia, students must learn the materials (dances, music, crafts, and/or drumming). At performances and activities, the Directors shall decide which dances the performers shall dance and provide the formations for each dance. It is the responsibility of each performer to have all their costumes complete, clean, and presentable for performances. For "Paid Performances", the amount of pay is determined by the Directors.

  7. Costumes: Members assume responsibility for buying and/or making required performance costumes. The Directors will provide supplies and/or instruction on making and buying performance costumes. Costumes belong to each performer, and it is their responsibility to ensure they are complete, clean, and presentable for all performances. It is not advised to borrow or lend costumes as it is unsanitary.

  8. Personal Performances: Any material (dances, music, & costumes) taught and performed by Manuia shall be used only in Manuia performances and only by Members. The Directors realize that there are family/friend events that students like to independently perform at, but it is the Member's responsibility to notify and obtain permission from the Directors to perform at such events. Failure to adhere to these requirements may lead to termination of membership from Manuia.

  9. Problems and Suggestions: Any problems or suggestions pertaining to Manuia should immediately be brought to the attention of the Directors to be resolved. If the problems are not resolvable, the Directors may, at its discretion, elect to terminate membership from Manuia.

  10. Release (injury to myself or my personal properties): Both I, and on behalf of my dependent(s), my personal representatives, estate, heirs, next of kin and assigns, release Manuia, its Directors, instructors, students, guardians, musicians, drummers and volunteers of any injury to myself or my dependent(s) and for any and all claims and causes of action for loss or damage to my property and for any injury to my person arising from the participation in Manuia classes, performances, activities or rehearsals.
